Terms & Conditions - Sail La Vie

These terms and conditions govern the booking and participation in any sailing activity or service provided by Sail La Vie. By booking or participating in any activity with us, you agree to ​the following terms:

1. Booking & Payment

1.1. A deposit of 50% of the total booking fee is required to secure your reservation.
1.2. Full payment must be received no later than 30 days before the scheduled departure date. If a booking is made within 30 days of departure, full payment is due at the time of booking.
1.3. Payments can be made via credit card, bank transfer, or other specified methods. All prices are in CAD unless stated otherwise.
1.4. Failure to make timely payments may result in cancellation of the ​booking without refund.

2. Cancellation & Refund Policy

2.1. Cancellations made by the customer more than 60 days before the departure date will be refunded in full, minus a 5% processing fee.
2.2. Cancellations made between 30 and 60 days before departure will result in a 50% refund of the total booking fee.
2.3. Cancellations made within 30 days of departure will not be eligible for a refund.
2.4. Sail La Vie reserves the right to cancel any sailing tour due to unforeseen circumstances (e.g., weather conditions, technical ​issues). In such cases, a full refund will be provided, or the option to reschedule will be offered.

3. Insurance

3.1. Sail La Vie strongly recommends that all participants purchase comprehensive travel insurance, including coverage for trip cancellations, medical expenses, and personal liability.
3.2. Sail La Vie is not responsible for any personal injury, damage, or loss of personal belongings ​during the trip.

4. Health & Safety 

4.1. Participants are required to disclose any medical conditions or limitations that may affect their ability to participate in the sailing activities.
4.2. Sail La Vie reserves the right to refuse participation to anyone deemed medically unfit or unable to meet the safety requirements of the tour.
4.3. All participants must comply with the safety instructions provided by the crew and instructor. Failure to do so may result in removal from the activity without refund.

5. Weather & Itinerary Changes 

5.1. Sail La Vie reserves the right to modify the itinerary or route based on weather conditions or other safety concerns. Changes may be made at the discretion of the captain or instructor to ensure the safety and comfort of all participants.
5.2. Weather conditions are not grounds for ​refunds unless Sail La Vie cancels the entire tour.

6. Liability 

6.1. Sail La Vie is not liable for any injury, loss, or damage sustained by participants during the tour unless caused by the gross negligence or intentional misconduct of Sail La Vie or its crew. 
6.2. Participants agree to release, waive, and discharge Sail La Vie from any claims or liability ​arising from their participation in any sailing activity.

7. Code of Conduct 

7.1. Participants are expected to behave in a respectful manner toward crew members and other guests. Any inappropriate, illegal, or disruptive behavior may result in removal from the tour without refund.
7.2. Damage to the yacht or equipment caused by negligent or intentional actions ​of a participant will be charged to the participant responsible.

8. Photography & Media 

8.1. By participating in a Sail La Vie tour, participants consent to being photographed or filmed during the trip for promotional purposes. If you do not wish to be photographed or filmed, please ​notify us in advance.

9. Force Majeure 

9.1. Sail La Vie shall not be held responsible for any delay, cancellation, or disruption caused by circumstances beyond its control, including but not limited to natural disasters, political unrest, ​pandemics, or governmental restrictions.

10. Governing Law 

10.1. These terms and conditions are governed by and construed in accordance with the laws of St. Maarten. Any disputes arising from the booking or participation in a tour will be subject to the exclusive jurisdiction of the courts of St. Maarten.

Terms and Conditions for Children’s Sailing Adventures

These terms and conditions apply to any booking and participation in sailing activities for children under the age of 18 with Sail La Vie. By booking or participating, you agree to the following terms:

1. Parental/Guardian Supervision 

1.1. A parent or legal guardian must accompany children under the age of 18 during all sailing activities unless prior written consent is given for participation without supervision.
1.2. Sail La Vie does not take responsibility for the care of children beyond the scope of the sailing program. ​Parents or guardians must ensure the child adheres to all safety protocols.

2. Insurance 

2.1. Sail La Vie strongly recommends purchasing comprehensive travel insurance that includes coverage for trip cancellations, medical expenses, and personal liability for all children.
2.2. Sail ​La Vie is not responsible for any injury, damage, or loss of personal belongings during the trip.

3.1. Parents or guardians must disclose any medical conditions or limitations that may affect the child’s ability to participate in sailing activities.
3.2. Sail La Vie reserves the right to refuse participation to any child deemed medically unfit or unable to meet the safety requirements of the tour.

4. Weather & Itinerary Changes

4.1. Sail La Vie reserves the right to modify the itinerary based on weather conditions or other safety concerns. Changes may be made at the discretion of the captain to ensure the safety of all participants, including children.
4.2. Weather conditions are not grounds for refunds unless Sail ​La Vie cancels the entire tour.

5.1. Sail La Vie is not liable for any injury, loss, or damage sustained by children during the tour unless caused by the gross negligence or intentional misconduct of Sail La Vie or its crew.

6.2. Damage caused to the yacht or equipment due to negligent or intentional ​actions by a child will be charged to the parent or guardian responsible.

7. Photography & Media  

7.1. By participating in a Sail La Vie tour, parents or guardians consent to their child being photographed or filmed for promotional purposes. If you do not wish for your child to be ​photographed, please notify us in advance.
